Kansas law defines assault and battery as:

  • Assault: Assault is intentionally placing another person in reasonable apprehension of immediate bodily harm. There does not have to be actual contact with an assault charge. A threat will constitute assault.
  • Battery: Battery is intentionally or recklessly causing bodily harm to another person; or intentionally causing physical contact with another person when done in a rude, insulting or angry manner. Unlike assault, battery requires actual contact.

The use of a weapon will cause an assault or battery charge to become an aggravated assault or an aggravated battery. Aggravation seriously increases the charge and the penalties. Your criminal history will also affect the consequences of the crime. If you have a record, you may go to prison.
