The trial court committed harmless error when it failed to obtain a waiver of the defendant’s right to be present in open court and answered a question posed by the jury during deliberations without the defendant being present. Under K.S.A. 22- 3420(3), the right applies whenever the jurors "desire to be informed as to any part of the law or evidence."
