Another win for the good guys. Possession of marijuana and possession of marijuana with no tax stamp meets both prongs of the double jeopardy test –they arise from the same conduct—and by statutory definition they constitute a single crime and violate a person’s right not to be convicted of both a greater and lesser crime under K.S.A. 21-3107(2)(b) (now K.S.A. 21-5109(b)(2))
