PROTECTION FROM ABUSE (PFA) AND PROTECTION FROM STALKING (PFS) ORDERS
Protection from Abuse Orders
PFA orders are for victims of domestic violence. Domestic violence occurs when an intimate partner or household member intentionally attempts to cause bodily injury; intentionally or recklessly causes bodily injury; intentionally places, by physical threat, another in fear of imminent bodily injury; or commits any sexual act with someone under 16 to whom they are not married.
Protection from Stalking Orders
You do not need to be in a relationship to qualify for a PFS order. Kansas law defines stalking as "an intentional harassment of another person that places the other person in reasonable fear for that person's safety" and harassment as "a knowing and intentional course of conduct directed at a specific person that seriously alarms, annoys, torments or terrorizes the person, and that serves no legitimate purpose." The harassment must be of two or more separate acts over a period of time which would cause a reasonable person to suffer substantial emotional distress.

Unfortunately, there are times when the system itself is abused. Both PFA and PFS orders are meant to protect, but sometimes end up creating victims. If someone has wrongfully filed a petition for PFA or PSA against you, I can help. The law requires a hearing within 21 days of filing the petition. This means that you have an opportunity to be heard; even if the Court has issued temporary orders. At the hearing the Court may enter orders that prevent you from having contact with the reporting party and/or your minor child, restrain you from entering or remaining in your residence, require you to pay temporary support or maintenance, require you to pay attorney fees and even require you to seek counseling for abuse. It is important that you defend yourself at the hearing to ensure that your rights are protected.
